Contractual Aircraft Mortgage

Abstract

First, this study covers why aircrafts are required to be pledged through registration with a registry, as distinct from the general legal regime of movables. Then, it explains the effects of the Cape Town Convention and the Protocol to the Convention, which protect certain securities over aircrafts at an international level. Following this, the study examines the principles underlying aircraft mortgages and seeks to answer over what aircrafts a mortgage can be established under the Turkish Civil Aviation Code. The following sections deal with the whole process of mortgaging an aircraft, starting from its establishment to its termination, and evaluate the discussions as well as problems regarding this.

Özet

Bu çalışmada, öncelikle, hava araçlarının, taşınırlara ilişkin genel hukukîrejimden farklı olarak, neden sicile kaydedilerek rehnedilmesi gerektiğiüzerinde durulmuştur. Ardından hava araçları üzerinde tesis edilebilen bazıteminatları uluslararası düzeyde koruyan Cape Town Sözleşmesi’nin ve bunailişkin Protokol’ün etkileri ele alınmıştır. Sonrasında, Türk Sivil HavacılıkKanunu’na göre hangi hava araçları üzerinde ipotek kurulabileceği incelenmişve hava aracı ipoteğine hâkim olan ilkeler irdelenmiştir. Devam edenbölümlerde, sözleşmeye dayanan hava aracı ipoteğinin tesisinden sonaermesine kadar olan tüm süreç ortaya koyularak tartışmalar ve sorunlarailişkin değerlendirmeler yapılmıştır.
