Evaluation of the Law No. 6360 within the Framework of Whole-ofGovernment Approach

Bütünleşik Kamu Yönetimi Yaklaşımı Çerçevesinde 6360 Sayılı Kanun’un Değerlendirilmesi

Abstract

In the late 1990s, whereas the New Public Management(NPM) approach was criticized for not being able to achieve the targeted success, new alternative approaches were started to be developed. One of these approaches that emerged in this period has been Whole-of- Government (WG) approach and its coordination criticisms of the fragmented administrative structure that it has created by the NPM approach within the framework of reforms. It is seen that these criticisms brought up in the Turkish public administration, which was restructured in line with the ongoing reforms in the 2000s.The problem of coordination is clearly stated in the justification of the Draft Law regarding the amendments to be made in the Metropolitan Municipality Law No.6360 which was enacted in 2012. The study aims to examine WG approach and then Law No. 6360 within the scope of this approach.

Özet

1990’ların sonu Yeni Kamu İşletmeciliği (YKİ) yaklaşımının kamu yönetiminde hedeflenen başarıyı sağlayamadığı gerekçeleriyle eleştirildiği, alternatif yaklaşımlarınyükseldiği bir dönem olmuştur. Bu dönemde ortaya çıkan yaklaşımlardan birisi de Bütünleşik Kamu Yönetimi (BKY) ve onun YKİ yaklaşımın yürüttüğü reformlar kapsamında yarattığı parçalı yönetsel yapıya yönelik koordinasyon eleştirileri olmuştur. Bu eleştirilerin, 2000’lerde devam eden reformlar doğrultusunda yeniden yapılandırılan Türk kamu yönetiminde de gündeme geldiği, koordinasyon sorununun 2012 yılında kabul edilen 6360 Sayılı Büyükşehir Belediye Kanunu ile Bazı Kanun ve Kanun Hükmündeki Kararnamelerde Değişiklik Yapılmasına Dair Kanun Tasarısı’nın gerekçesinde açıkça ifade edildiği görülmektedir. Çalışma, BKY yaklaşımını ve yaklaşım kapsamında 6360 Sayılı Kanunu’nu incelemeyi amaçlamaktadır.
