Reflections of recent changes in public tender system on time and cost of construction investements

Abstract
The present study aims to compare National Procurement Law, Number 2886, which became valid after the January 1st 1984 and Public Procurement Law, Number 4734, which became valid after the January 1st 2003. So this study provides basis to compare each variants between the planned and actual cost and duration of projects which undertaken by these two procurement laws. At the end of the investigation some significant conclusions have been achieved which enable to contributing to use of public resources more efficiently, in accordance with Tender Low Number 4734.
Özet
Bu çalışmada, 01.01.1984 yılında yürürlüğe giren 2886 sayılı Devlet İhale Kanunu ile 01.01.2003 yılında yürürlüğe giren 4734 sayılı Kamu İhale Kanunun arasındaki farklılıkların irdelenmesi hedeflenmiştir. Bu bağlamda her iki ihale kanununa dayalı olarak gerçekleştirilen kamu inşaat projeleri incelenerek, bunların gerçekleştirilmesi sürecinde meydana gelen süre ve maliyet sapmaları karşılaştırılmıştır. Çalışma sonucunda, 4734 sayılı ihale yasasının, kamu kaynaklarının verimli kullanılmasına katkı sağlar nitelikte düzenlemeler içerdiğine ilişkin önemli bulgulara ulaşılmıştır.
