(EFFECTIVE USE OF BUDGET RIGHT: THE NEGOTIATION OF COURT OF ACCOUNTS REPORTS IN TURKISH GRAND NATIONAL ASSEMBLY)

BÜTÇE HAKKININ ETKİN KULLANILMASI: SAYIŞTAY RAPORLARININ TBMM'DE GÖRÜŞÜLMESİ

Abstract

The Bugdet Right, which is a democratic right, is a broad concept that includes the auditing of transactions as well as authorize to make expenditure and collect revenue. In Turkey Turkish Grand National Assembly has the auditing power which is arising from the budget right. The Court of Accounts is the body that performs and reports these audits on behalf of the parliament. The disputes arising in the evaluation and negotiation of the Court of Accounts reports cause the parliament to be unable to perform the auditing part of the budget right as required. In this context, it is necessary to establish subcommittees to evaluate carefully the audit reports of Court of Accounts to ensure fiscal transparency and accountability.

Özet

Demokratik bir hak olan bütçe hakkı, gelir ve harcama yapma konusunda izin ve yetki vermenin dışında yapılan işlemlerin denetimi de içeren geniş bir kavramdır. Türkiye'de bütçe hakkından ileri gelen denetim yetkisi TBMM'de bulunmaktadır. Bu denetimleri parlamento adına gerçekleştiren ve raporlayan kuruluş ise Sayıştay'dır. Sayıştay raporlarının değerlendirilmesi ve görüşülmesinde ortaya çıkan aksaklıklar parlamentonun halk adına kullanmakta olduğu bütçe hakkının denetim ayağının yeteri kadar gerçekleştirilememesine neden olmaktadır. Bu bağlamda, bütçe hakkının bir parçası olarak değerlendirilmesi gereken mali şeffaflık ve hesap verilebilirliğin sağlanabilmesi açısından Sayıştay denetim raporlarının dikkatle değerlendirileceği alt komisyonlar kurulması gerekmektedir.
