REMUNERATION RIGHT OF JOURNALISTS

Abstract

Remuneration right is one of the vital rights for journalists as well as for all employees. Remuneration, which determine the income and quality of life of journalists as the only vital source of income and influ-ence their motivations and perceptions towards work and social status is one of the important elements of working life. In this respect, remunera-tion can often be considered the sole reason for the exercise of the right to work. As one of the indispensable rights of working life, remuneration right is accepted and guaranteed as a social right in the 1982 Constitu-tion as in the international conventions. In accordance with the 1982 Constitution, employees have been granted remuneration rights by vari-ous laws and journalists have been granted remuneration rights under the Press Labor Law. In this study, journalists' right to remuneration according to the Press Labor Law will be examined comparatively with the provisions of the Labor Law which regulates the same issue within the framework of the opinions in the doctrine and the decisions of the Supreme Court.

Ücret hakkı, tüm çalışanlar için olduğu gibi gazeteciler açısından da yaşamsal öneme sahip haklardan birisidir. Zira tek yaşamsal gelir kaynağı olarak diğer çalışanlar gibi gazetecilerin de gelirlerini ve yaşam kalitelerini belirleyen, toplumsal statüleri ile işe ilişkin algıları ve moti-vasyonları üzerinde etkili olan ücret, çalışma yaşamının önemli unsurla-rından biridir. Bu yönüyle ücret, çalışma hakkının kullanımının çoğu zaman yegâne sebebi olarak düşünülebilir. Çalışma yaşamının vazgeçil-mez haklarından biri olarak ücret hakkı, uluslararası sözleşmelerde oldu-ğu gibi 1982 Anayasasında da sosyal bir hak olarak kabul edilmiş ve güvence altına alınmıştır. 1982 Anayasasına uygun olarak çeşitli kanun-larla bugüne kadar çalışanlara ücret hakkı verildiği gibi Basın İş Kanunu ile de gazetecilere ücret hakkı verilmiştir. Bu çalışmada, öğretideki gö-rüşler ve Yargıtay kararları çerçevesinde Basın İş Kanunu’na göre gaze-tecilerin ücret hakkı, aynı konuda düzenleme getiren İş Kanunu hüküm-leri ile karşılaştırmalı olarak incelenecektir.
