THE ROLE OF JUDICIAL COMMISSION IN SUPERVISING THE JUDGES AGAINST THE DILEMMA OF THE JUDICIAL INDEPENDENCY

Abstract

Accountability against the performance of judges and the institutions of Supreme Court is the implementation of the principle of checks and balances of the judicial institution. The idea is based on the concept of the independency of judicial power dilemma which is potentially judicial tyranny as the deviation of behavior and ethics. Instrument of the accountability to the performance of judges is done by enforcement effort on mechanism of the Honorary Assembly of Judges against the judges who has proven violated the Code of Ethics and Code of Conduct of judges with the sanctions in the form of permanent dismissal. The imposition of the sanction is the authority or domain of the Judicial Commission and the Supreme Court as the application of the principle of checks and balances.

Özet

Hakimlerin ve yüksek yargı kurumlarının işleyişinin denetlenmesinde kontrol ve dengeler ilkesi etkilidir. Bu görüş davranışsal ve ahlaki sapmalara uğradığı ölçüde bir yargı diktatörlüğüne dönüşmesine karşın yargı bağımsızlığını gözetme düşüncesine dayanır. Hakimler Yüksek Kurulu, hakimleri, etik ve davranışsal kuralları ihlal etmeleri halinde kalıcı süreyle işten men ile sonuçlanabilecek şekilde yaptırım mekanizmaları üzerinden denetler. Yaptırımın tahmili, kontrol ve dengeler ilkesi uygulanması bağlamında Adliye Encümeni ile Yargıtayın yetki ve etki alanındadır.
