Abstract
The purpose of New York Convention is to envisage cooperation between states regardingthe recovery of cross border maintenance. New York Convention was entered into force in1957 and is applied when the creditor is in the territory of one contracting state and therespondent is another contracting state. In this work, the methods for recovery abroad ofmaintenance are firstly be framed and later the problems arise in practice and possible solutionsto these problems are identified in the light of the decisions of the Court of Cassation.

New York Sözleşmesi, sınır aşan nafaka alacaklarının tahsili konusunda devletler arasındaişbirliğini öngörmektedir. 1957 yılında yürürlüğe giren New York Sözleşmesi, nafakaalacaklısı ve nafaka borçlusunun farklı ülkelerde bulunması halinde uygulanmaktadır.Çalışmamızda, New York Sözleşmesi kapsamında nafaka alacağının tahsili için öngörülenyollar açıklandıktan sonra Yargıtay kararları ışığında uygulamada karşılaşılan sorunlarve bu sorunlara ilişkin çözüm önerileri üzerinde durulacaktır
