Türkiye Büyük Millet Meclisi Avrupa Birliği uyum komisyonu üzerine bir değerlendirme

Abstract

European Union (EU) committees are in place with its functions and powers in the national parliaments of EU member and candidate states. The working procedures and scope of the powers of these committees vary among countries and between candidate and member states. In each candidate state, mostly, a committee responsible for EU affairs is the main unit of the parliament in the accession process. Though Foreign Affairs Committees, also, follows the accession process, it is not mainly under their responsibility. In Turkey’s accession process to the EU, the Committee on EU Harmonization is established in Grand National Assembly of Turkey (GNAT) in 2003 with a view to following and debating the developments regarding accession, monitoring the developments in the EU and informing the GNAT concerning these developments and, if asked for, submitting opinion to main committees after examining the compliance of the draft bills with the acquis communautaire. In the present study, role and efficiency of the EU Harmonization Committee will be examined in the period of 22 and 23. legislative terms and of 24. term as needed. Additionally, activities and initiatives with the objective to increasing the efficiency of the Committee will be held.

Özet

Avrupa Birliği (AB) üye ve aday ülke parlamentolarında çeşitli görev ve yetkilerle donatılmış AB komisyonları faaliyet göstermektedir. Bu komisyonların yetki kapsamları ve çalışma usulleri, ülkeden ülkeye ve aynı zamanda aday ve üye ülkelerde farklılık göstermektedir. Her aday ülke parlamentosunda genellikle AB işlerinden sorumlu bir komisyon, katılım sürecinde temel sorumlu birim olarak faaliyet göstermektedir. Dışişleri komisyonları da katılım sürecini izlemekle birlikte AB katılım süreci bu komisyonların temel sorumluluk alanları olmamaktadır. Türkiye’nin AB’ye katılım sürecinde de katılıma ilişkin gelişmeleri izlemek ve müzakere etmek, AB’deki gelişmeleri takip etmek ve bu gelişmeler konusunda Türkiye Büyük Millet Meclisi’ni (TBMM) bilgilendirmek ve istenildiğinde kanun önerilerinin AB müktesebatına uygunluğunu inceleyerek ihtisas komisyonlarına görüş sunmak üzere TBMM’de AB Uyum Komisyonu (ABK) 15. 4. 2003 tarihli ve 4847 sayılı Kanun ile kurulmuştur. Bu çalışmada, ABK’nin kuruluş amacına yönelik etkinliği ve TBMM kurumsal yapısı içerisindeki konumu, esas olarak 22. ve 23. Yasama Dönemleri itibariyle ele alınacak olup yeri geldikçe 24. Yasama Dönemi faaliyetlerine de değinilecektir. Ek olarak, Komisyonun etkinliğini artırmaya yönelik TBMM bünyesinde yürütülen çeşitli faaliyetler ya da girişimler de ele alınacaktır.
