Seçimlere Katılma Oranının Siyasi Sisteme Etkisi Üzerine Gözlemler

Abstract

Elections and referendums are decisive legal tools that include the electors tothe government of a country in the representative democracies. The turnoutratio of the electors bears a significant importance since it determines thepolitical social ramifications of a given election. Considering that there is noparticipation quorum in the current legislation of the Turkish electoral system,a decrease in the turnout may have a negative political impact even if no legalissue is raised. In other words, a low voter turnout –stemming from“absenteeism” or “boycott”– is prone to create socio-political legitimacydeficit despite the observation of the rules of formality. This results in thevotes which are legally binding but having a weak social support

Seçimler ve halkoylamaları temsilî demokrasilerde seçmenleri yönetime dâhileden belirleyici hukukî araçlardır. Seçmenlerin oylamalara katılım oranı ilgiliseçimin sosyo-politik sonuçlarını belirlemesi bakımından büyük önem taşımaktadır. Mevcut seçim kanununda katılım yetersayısının öngörülmemesi nedeniyle, katılım oranının düşüklüğünün negatif bir politik etkisi olsa bile hukukî bir sonucu söz konusu olmayacaktır. Diğer bir deyişle, “ilgisizlik” ya da“boykot”tan kaynaklanan düşük katılım oranı, sosyo-politik meşruiyetini zayıflatsa da hukukî geçerliliğe tesir etmeyecektir. Bu sonuç da toplumsal desteği zayıf ve fakat hukuken bağlayıcı oylamalara yol açacaktır
