The relationship sovereigntr between the Europe union and the member states

Abstract

A case of sovereignty, international law discipline is one of the most popular and also the most challenging issues. The main actors in international law, which states that global cooperation over the world as a result of introduction of the concept of sovereignty has lost many things in the conventional sense. In this context, the transfer of sovereignty issues to international and supranational organizations has prepared the groundwork for serious discussions. European Union (EU) nations over the original structure in the center of this debate are an important example of integration. Therefore, the sovereignty of member states have developed relations with the EU is of a quality worthy of review. Both in law and political aspects of the sovereignty of relations between the EU and member states should be seen and evaluated correctly. Otherwise, sovereign relations between the EU and its member countries can lead to incorrect interpretations.

Egemenlik olgusu, Uluslararası Hukuk disiplininin en gözde ve aynı zamanda en çetin konularından biridir. Uluslararası hukukun temel aktörleri olan devletler, dünya üzerinde giriştikleri küresel işbirliği neticesinde egemenlik kavramı klasik anlamından çok sey yitirmistir. Bu çerçevede, uluslararası ve ulus-üstü örgütlere egemenliğin devri konusu ciddi tartışmalara zemin hazırlamıştır. Avrupa Birliği(AB) ulus-üstü özgün yapısıyla bu tartışmaların merkezinde yer alan önemli bir entegrasyon örneğidir. Bu itibarla, üye devletlerin AB ile geliştirdikleri egemenlik münasebeti incelemeye değer bir nitelik taşımaktadır. Egemenliğin hem hukuki hem de siyasi yönü AB ve üye ülkeler arasındaki münasebette doğru görülmeli ve değerlendirilmelidir. Aksi takdirde AB ve üye ülkeler arasındaki egemenlik ilişkisi yanlış yorumlamalara neden olabilmektedir
