CONFIDENTIALITY IN INTERNATIONAL ARBITRATION

Abstract
In this study, the notion of conf identiality in international arbitration is examined f rom various perspectives. Issues addressed in the study include the question of whether or not conf identiality is a procedural or substantive concept, and whether or not conf identiality is in the nature of arbitration. The subj ect matter is explored f rom a comparative law point of view, by analyzing the laws of various countries in the Common law and Continental European j udicial systems as well as the rules of certain arbitral institutions. The study also examines the entities with respect to which conf identiality has to be ensured, the legal sources of it, the exceptional situations that require the lif ting of the conf identiality veil, the temporal aspects of conf identiality and the consequences of violating the principle of conf identiality.
Özet
Bu çalışmada, milletlerarası tahkimde gizlilik kavramı çeşitli yönleriyle incelenmiştir. Tahkimin gizliliğinin usulü mü yoksa maddi hukuka mı ilişkin olduğu keza tahkim yargılamasının özünde gizliliğin var olup olmadığı inceleme konusu yapılmıştır. Mukayeseli hukuk açısından Common Law ve Kıta Avrupası hukuk sisteminin hakim olduğu çeşitli ülkelerin milletlerarası tahkim kanunları ile kurumsal tahkim merkezlerinin tahkim kurallarında gizliliğin ne şekilde düzenlendiği de irdelenmiştir. Bunun dışında tahkimin gizliliğinin muhafazasının kimler için söz konusu olacağı, hukuki kaynakları, gizlilik perdesinin kaldırılmasını gerektiren istisnai haller ile gizliliğin zaman boyutu ve gizliliğin ihlalinin hukuki sonuçları çalışmanın kapsamı içindedir.
