Abstract
The purpose of this article is to provide an assessment regarding the legal nature of "recognition " which allows f oreign court decisions to gain res j udicata eff ect in Turkey and which also determines the adj udication procedure; and to identif y the courts that have competence and j urisdiction over the recognition process carried out pursuant to PILA no. 5718 as well as the j udicial review of the decisions made by such courts. In developing our assessment, we took note of the inadequacy of the legal provisions currently in f orce, and the problems caused by the incompatibility between the prevailing opinion in academia/practice regarding the legal nature of "recognition " and its legal structure.
Özet
Bu çalışmada, özel hukuka ait yabancı mahkeme kararlarının Türkiyede kesin hüküm etkisinden yararlanılmasını sağlayan tanıma müessesesinin, aynı zamanda yargılama usûlünü de belirleyecek olan hukukî niteliği ile mevcut kanunî düzenlemenin yetersizliği, hukukî niteliğiyle ilgili doktrin/uygulamada genel kabul gören görüşün, tanımanın hukukî yapısı ile olan uyuşmazlığı nedenleriyle karşılaşılan güncel sorunlara ilişkin yapılan bir tespit dâhilinde, 5718 sayılı MÖHUK kapsamında gerçekleşen tanıma faaliyetini yürütecek görev ve yer itibariyle yetkili mahkemelerin ve bu yargılama esnasında uygulayabilecekleri usûl hükümlerinin tayini; verecekleri kararların yargısal denetimini kapsayan bir tahlil amaçlanmıştır.
