Abstract
21. yüzyılda gelişen uluslararası ticaret hacmiyle bağlantılı olarak ortaya çıkan global hukuk bürolarının, hakemlerin bağımsızlık ve tarafsızlığının belirlenmesinde büyük etkiye sahip olduğu görülmüştür. Öyle ki, aynı hukuk bürosunun farklı ülkelerdeki kollarını oluşturan avukatların piyasadaki geçmiş veya mevcut ilişkilerinin hangi ölçüde hakemlerin ifşa yükümlülüğü kapsamına girdiği sıklıkla gündeme gelmektedir. Konunun önemi gerek tahkim yargılaması öncesi hakemlerin ifşa yükümlülüğünün kapsamı açısından, gerekse de tahkim yargılaması sonucunda alınan kararın iptali veyahut icrasının reddi ile taraflar açısından ortaya çıkmaktadır. Buna rağmen, dünyadaki en yoğun ve önemli tahkim merkezlerinden olan Fransa, İngiltere ve Amerika Birleşik Devletleri mahkemeleri geçtiğimiz iki senede hakemlerin ifşa yükümlülüğünün kapsamı konusunda farklı kriterler uygulamışlardır. Her bir yargılama sisteminin birbirinden bağımsız olarak uyguladığı bu kıstaslar, uluslararası ticari tahkim güvenliğini hem taraflar hem de hakemler bakımından tehlikeye düşürmektedir. Uluslararası tahkim mantığına tamamen aykırı olarak, tahkim yargılamasının kaderi, tahkim yargılamasının görüldüğü yere veyahut söz konusu kararın icra edilmek istendiği yargılama sistemine bağlı olarak değişmektedir. İşbu çalışmada, durumun vahametine işaret etmek amaçlanmakla birlikte, çözüm önerileri sunulmaktadır.
Özet
In the 21st century, growth of the international trading volume has lead the foundation of huge and global law firms which now have a substantial impact on the determination of the independence and impartiality of the arbitrators. Specifically, the scope of disclosure obligations of the arbitrators is being frequently considered in terms of current and past relationships of the arbitrators working in different branches of the same law firm. The importance of the issue reveals itself in the scope of disclosure obligations that the arbitrators encounter as well as the criteria in determining the annulment or refusing enforcement of the arbitral awards which the arbitration parties encounter. Nevertheless, France, England and USA which are very important and the busiest arbitral seats around the world have applied different criteria in determining the scope of disclosure obligations of the arbitrators in the last two years. The criteria that have been applied in these significant seats in a divergent manner endanger the dependability of international commercial arbitration for both the parties to the arbitration and the arbitrators. Destiny of an arbitral award varies by the place of arbitration or the place that the award is being planned to be enforced which is quite the opposite of the rationale of international arbitration. Hereby with this study, the importance of the issue will be demonstrated with the possible solutions.
