Abstract

The indispensable and most fundamental element of the democratic regime is the freedom to express and disseminate ideas. One of the main tools in the exercise of this freedom is to organize meetings and demonstration marches in order to freely express their thoughts to the public. Therefore, acts were needed to regulate, protect and, when necessary, limit the right to assembly and demonstration, which is an extension of freedom of thought. The mentioned right is protected by the Constitution and the European Convention on Human Rights (ECHR), due to the importance of the democratic values it represents. On the other hand, international norms have been regulated in order that possible interventions of the states towards the right of assembly and demonstration do not cause arbitrariness and violations. Unfortunately, Turkey is the third country that led up to in terms of violation of freedom of assembly in order for the European Court of Human Rights decisions. In addition to the cases before the ECHR, the Constitutional Court has ordered many jurisprudence in the context of the right to assembly and demonstration since 2012. In this study, the legality of the interventions of the state and law enforcement forces to the right will be discussed in the light of domestic law, international agreements and case law.

Özet

Demokratik rejimin vazgeçilmez ve en temel unsuru düşünceleri açıklama ve yayma özgürlüğüdür. Söz konusu özgürlüğün kullanılmasında başlıca araçlardan biri, kamuoyuna düşüncelerini serbestçe ifade edebilmek adına toplantı ve gösteri yürüyüşleri düzenlemektir. Dolayısıyla, düşünce özgürlüğünün bir uzantısı olarak karşımıza çıkan toplantı ve gösteri yürüyüşü hakkını düzenleyen, koruyan, ve gerektiğinde sınırlayan yasalara ihtiyaç duyulmuştur. Anılan hak, temsil ettiği demokratik değerlerin önemi itibariyle, bizzat Anayasa’ca ve Avrupa İnsan Hakları Sözleşmesi’nde1 (AİHS) korunmaktadır. Öte yandan, devletlerin toplanma ve gösteri yürüyüşü hakkına yönelik olası müdahalelerinin keyfiyete ve ihlallere yol açmaması adına milletlerarası normlar düzenlenmiştir. Ancak ne yazık ki Türkiye, Avrupa İnsan Hakları Mahkemesi (AİHM) önünde toplanma özgürlükleri açısından en fazla ihlale yol açan üçüncü ülke konumundadır.2 AİHM önünde görülen davaların yanı sıra Anayasa Mahkemesi (AYM) de 2012 yılından bugüne toplanma ve gösteri yürüyüşü hakkı bağlamında birçok içtihata imza atmıştır. Bu çalışmada devletin ve kolluk güçlerinin söz konusu hakka müdahalelerinin hukuka uygunluğu, iç hukuk, milletlerarası anlaşmalar ve içtihatlar ışığında tartışılacaktır.
