Abstract
Communities are living human beings provide peace and well-being in society After the ruling class, perhaps the most important need is for those who will solve the disputes that arise between them. The Judge is also a person and can unjust decides intentionally or unintentionally. The causes that push judge to decide unjust intentionally can be money or benefist that meas bribe. Other than this if a person who does not have the qualifications to be a judge has been appointed to the judge's profession, even if he makes an exaggerated mistake so that it does not fall prey to justice, justice is not fulfilled and the citizens become victims. Regarding the responsibility or irresponsibility of judges who perform such a crucial task in society, we will try to consider comparatively the situation in Islamic law and the positive law.
Özet
Topluluklar halinde yaşayan insanoğlu, toplumda huzuru ve refahı sağlayacak yönetici sınıftan sonra belki de en önemli ihtiyaç olarak aralarında ortaya çıkan uyuşmazlıkları çözecek olan kişilere gereksinim duymuştur. Hâkim de insandır ve isteyerek veya istemeyerek haksız hüküm verebilir. Hâkimi kasten haksız hüküm vermeye iten sebep para veya menfaat gibi hususlar yani rüşvet olabilir. Bunun dışında eğer hâkim olabilecek niteliklere sahip olmayan bir kişi hâkimlik mesleğine atanmış ise bu kişi hâkime yakışmayacak şekilde bir fahiş hata yaparsa adalet yerine getirilmemiş olur ve bu sebeple vatandaşlar mağdur olur. Toplum içinde bu derece önemli bir görevi yerine getiren hâkimlerin sorumluluğu veya sorumsuzluğu konusunda İslam hukukundaki durum ile pozitif hukuktaki durumu karşılaştırmalı bir şekilde ele almaya çalışacağız.
