Nullity Suits On Social Security Institution Payment Orders According To Act No. 6183

Sosyal Güvenlik Kurumunun 6183 Sayılı Yasaya Göre Ödeme Emri ve İptali Davaları

Abstract

By the Act No. 5510 on Social Insurance and General Health; Social Security Institution is entitled to the aurhnrity of proceeding and collecting its demands emerging from premium payments and other reasons in the context of Act No. 6185 on the Collecting Procedure of Public Claims. Social Security Institution asks for its specified demands by drawing up a payment order according to Act No. 6183. The obligator has to file a nullity suit in 7 days lapse of time in the authorized labour court, with one of the reasons such as he has no debt like that, that he has partially paid it or that the debt was timed out. The lapse of time periods for the Social Security Institution has been changed in time. In the payment order nullity suits fixed court and counsel fees are charged.

Özet

5510 Sayılı SOSyal Sigortalar ve Genel Sağlık Sigortası Kanununda, Sosyal Güvenlik Kurumuna, prim ve diğer alacaklarını 6183 sayılı Amme Alacaklarının Tahsili Usulü Hakkındaki Kanun uyarınca takip ve tahsil yetkisi verilmiştir. SGK, idari aşamada kesinleşmiş alacağını 6183 sayılı Kanuna göre ödeme emri düzenleyerek ister. Kurum borçlusu ödeme emrine karşı, günlük hak düşürücü süre içerisinde, böyle bir borcu olmadığı, kısmen ödediği veya zamanaşımına uğradığı sebeplerine dayanarak, yetkili iş mahkemesinde iptal davası açması gerekir. Kurum alacakları nedeniyle zamanaşımı süreleri zaman içinde değişikliğe uğramıştır. Ödeme emrinin iptali davalarında maktu harç alınır ve maktu vekâlet ücretine tabidir.
