Evaluation Within the Scope of the Decision of the Supreme Court of Appeals Jurisdiction General Assembly Regarding the Validity of Penal Clasuses in Fixed-Term Employment Contracts Which Were Concluded Without An Objective Reason

Abstract
According to the Labor Law No. 4857, fixed-term employment contracts that are not based on ob-jective reasons are considered as indefinite-term employment contracts. In such a case, the issue of whether or not the penal clauses will remain valid in order to prevent the contract from terminating before the expiry of the contract caused different views in the doctrine and between the depart-ments of the Supreme Court. After a long period of discussions, the Supreme Court of Appeals Jurisdiction General Assembly decided to combine the case-law on this issue on 08.03.2019. Özet
4857 sayılı İş Kanunu uyarınca, objektif sebebe dayalı olmayan belirli süreli iş sözleşmeleri belirsiz süreli iş sözleşmesi sayılmaktadırlar. Böyle bir du-rumda, bu sözleşmelerde düzenlenmiş bulunan, sözleşmenin süresinden önce bitirilmesini önleme-ye yönelik cezai şartların geçerliliklerini koruyup korumayacakları hususu doktrinde ve Yargıtay da-ireleri arasında farklı görüşlerin doğmasına sebep olmuştur. Tartışmalarla geçen uzunca bir dönemin ardından da Yargıtay İçtihadı Birleştirme Büyük Ge-nel Kurulu 08.03.2019 tarihinde bu konuya ilişkin bir İçtihadı Birleştirme Kararı vermiştir.
