Legal Nature of the Wage Drivers Get per Expedition in Road Transport

Abstract
Despite the prohibitions in foreign countries, in our country, there is a practice of drivers to get a wage per expedition (performance-based wage) in the road transport sector. This practice drives drivers to violate traffic rules contradictory to work safety in order to make more expedition and hence make a gain. The fact that employers tend to qualify this wage per expedition as travel al-lowance is as just negative as the above-mentioned result. Because when this travel allowance-qualification is accepted, this allowance will not be a part of wage any more, minimum wage will be the starting point, regarding the rights based on real wage. Again, in accordance with social in-surance and tax legislation, the tax and premium will not be deducted from the allowance. Therefo-re, determining the legal nature of the payments per expedition is of great importance and the issue has been examined in the context of the Court of Cassation judgments in this study.
Özet
Ülkemizde karayolu taşımacılık sektöründe ya- bancı ülkelerdeki yasaklamalara rağmen şoförlere sefer başına (performans esaslı) ücret ödenmesi uygulaması vardır. Bu uygulama şoförleri daha faz- la sefer ve dolayısıyla daha fazla kazanç amacıyla iş güvenliğine aykırı olarak trafik kurallarını ihlale sevk etmektedir. En az bu derecede olumsuz bir başka sonuç, işverenlerin sefer başına ödemeyi harcırah olarak nitelendirmeleridir. Çünkü harcırah nitelendirmesi kabul edildiğinde ücret eki olarak çıplak ücretten sayılmayacak, çıplak ücretin esas olduğu haklar asgari ücretten hareket edilecek- tir. Yine sosyal sigorta ve vergi mevzuatı uyarınca harcırahtan sigorta primi ile vergi kesilmeyecektir. Bu nedenle sefer başına ödemelerin hukuki niteli- ğinin belirlenmesi büyük öneme sahip olup, konu bu çalışmada Yargıtay kararları bağlamında ince- lenmiştir.
