The Concept of Trainee and Trainees’ Social Security

Abstract

In recent years, many regulations have been made regarding the working relations and insurance status of the worker group called trainee in an attempt to solve various legal problems about this subject matter. The main purpose of this study is firstly to define the concept of the trainee, then to evaluate the legal regulations concerning the legal status and social security of the trainees and the cur- rent practices. As a result of the study, it has been determined that the regulations related to the internship and trainee concepts cannot clearly reveal these concepts in all aspects. It has been emphasized that the trainees are not employees and the internship does not initiate the long term insurance period since they are only insured against occupational ac- cidents and diseases.

Stajyer olarak adlandırılan çalışan grubu- nun çalışma ilişkileri ve sigortalılık durumları ile ilgili olarak son yıllarda birçok düzenleme yapılarak konuya ilişkin çeşitli hukuki sorunlar çözüme kavuşturulmaya çalışılmıştır. Bu çalış- mada, öncelikle stajyer kavramının ortaya ko- nulması, ardından stajyerlerin hukuki statüsü ve sigortalılığına ilişkin hukuki düzenlemeler ile mevcut uygulamaların değerlendirilmesi amaçlanmıştır. Çalışmanın sonucunda, staj ve stajyer kavramlarına ilişkin düzenlemelerin, bu kavramları tüm yönleriyle net bir şekilde ortaya koyamadığı tespit edilmiştir.
