Özet
Ombudsmanlık kurumu kurulduğu tarihten itibaren birkaç değişikliğe uğrasa da devlet organlarına karşı insan hak ve özgürlüklerini korumak ve ihlal edilen hakların iade edilmesini tavsiye etmek gibi asli görevini sürdürmektedir. Yürütme organının faaliyetlerinin hukuki temellerini ve yasallığını denetleyen ombudsmanlık kurumu, Avrupa ülkeleri başta olmak üzere dünyanın birçok ülkesinde etkin bir şekilde faaliyet göstermektedir. Rusya Federasyonu’nda ise, bu kurum 12 Şubat 1997 tarihinde imzalanan “Rusya Federasyonu İnsan Hakları Ombudsmanı ile İlgili” federal yasa ile yürürlüğe girmiştir. Rusya Federasyonu parlamentosu tarafından atanan ve aynı zamanda bağımsız bir şekilde çalışan ombudsman; devlet memurları ve/veya devlet organları tarafından ihlal edilen insan haklarının iade edilmesi konusunda devlet ve vatandaşlar arasındaki bir köprü rolünü üstlenmektedir. Çalışmada Rusya Federasyonu’nda ombudsmanlık kurumunun nasıl ortaya çıktığı, yapısı ve işleyişinin ortaya konulması amaçlanmaktadır. Bu kapsamda çalışmada Rusya Federasyonu’nda insan haklarını koruma mekanizmaları, ombudsmanlık kavramı, Rusya Federasyonu’nda tarihsel gelişimi, Rusya Federasyonu’nda ombudsmanlık türleri, seçimi, yetki ve görevleri ile başvuru şartları ve değerlendirmeler ile bölge ombudsmanlık kurumları ele alınmıştır. Ombudsmanlık kurumu yıllık raporları çerçevesinde de mevcut durum ortaya konulmuştur.
Abstract
Although the ombudsman institution has undergone several changes since its inception, it retains its primary duty - to protect human rights and freedoms against state bodies and recommend the restoration of violated rights. The Ombudsman institution, which controls the legal basis and the legality of the activities of the executive body, is active in many countries of the world, especially in European countries. In Russian Federation this institution entered into force on 12 February 1997 in accordance with “The Law on Ombudsman for Human Rights in Russian Federation”. Ombudsman appointed by the Parliament of the Russian Federation and working independently; assumes the role of a bridge between the state and its citizens for the restoration of human rights violated by government officials and/or government bodies. In this study, it is aimed to reveal how the ombudsman institution emerged, its structure and functioning in Russian Federation. In this context, the study discussed the mechanisms for the protection of human rights in the Russian Federation, the concept of ombudsman, historical development in the Russian Federation, types of ombudsman in the Russian Federation, elections, powers and responsibilities, conditions of treatment and their consideration, as well as ombudsman institutions in the regions. The current situation at the Ombudsman Institute was created through annual reports.
