Abstract
The functions of the state are collected under the three heading titles which are executive (icra), legislative (yasama) and judicial (kaza) powers in terms of modern constitutional law. There are some elements of judicial power, too. The most important of these elements is the judge whose duty is securing the justice. In this study, such subjects have been discussed according to Islamic Law; assignment of the judge, required qualifications of the judge and points to consider while the judge is working.
Özet
Modern anayasa hukuku açısından ele aldığımız zaman devletin fonksiyonları, yürütme (icra), yasama (teşri’) ve yargı (kaza) olmak üzere üç ana başlık altında toplanmaktadır. Yargı sisteminin de bir takım unsurları vardır. Bu unsurlardan en önemlisi ise adaleti tevzi görevini ifa etmekle görevli hâkimdir. Biz bu çalışmamızda İslam Hukukuna göre, hâkimin atanması, hâkimde aranan şartlar ve bu görevi ifa ederken hâkimin dikkat etmesi gereken hususlar üzerinde durduk.
