THE EFFECT OF ENACTING REMEDY OF APPEAL ON THE COUNCIL OF STATE’S WORKLOAD

İSTİNAF KANUN YOLU DÜZENLEMESİNİN DANIŞTAY’IN İŞ YÜKÜ ÜZERİNE ETKİSİ

Abstract

While expecting a fair and equitable judgement; involving parties, also, hope it to be done as soon as possible. This is just the origin of the appeal procedure, which is put into force in accordance with the Law Number 6545 and practiced by the year 2016, in Turkey. The remedy of appeal has been introduced since the Council of State could not perform its major duty of stare decisis due to the reasons such as increased workload and over-extending judgement process. The study attempts to present whether the introduction of appeal procedure, as a solution to the increasing workload of the Council of State, has realized its objective through numerical data. The effect of remedy of appeal on the Council of State’s workload is examined with numerical data. Also, case finalising rates and workloads of regional administrative courts, in consideration of remedy of appeal enacted, are investigated. Based on the gathered numerical data, it is concluded that remedy of appeal has provided the expected returns.

Özet

Uyuşmazlıkların çözümünde taraflar adil ve hakkaniyete uygun bir yargılama beklerken aynı zamanda bunun en kısa sürede gerçekleşmesini umarlar. Ülkemizde 6545 Sayılı Kanun yolu ile yürürlüğe giren ve 2016 yılında fiilen başlanan istinaf incelemesinin çıkış noktası da budur. Danıştay’ın iş yükünün artmasıyla yargılamanın uzaması ve asıl görevi olan içtihat birliğini sağlama görevini yerine getirememesi gibi nedenlerle istinaf kanun yolu getirilmiştir. Bu çalışmada Danıştay’ın iş yükündeki artışa çözüm olarak istinaf kanun yolunun getirilme amacının gerçekleştirilip gerçekleştirilemediği sayısal verilerle ortaya konulmaya çalışılmıştır. Danıştay’ın iş yükü üzerindeki etkisi sayısal verilerle incelenmiştir. Ayrıca İstinaf sisteminin yürütülmesiyle birlikte bölge idare mahkemesinin dosya temizleme oranları ve üzerindeki iş yükü incelenmiştir. Yapılan inceleme sonucunda sayısal veriler ışığında istinaf kanun yolundan beklenen fayda sağlandığı anlaşılmaktadır.
