IMPROVEMENT PROCESS IN THE POSTPONEMENT OF BANKRUPTCY OF COMMERCIAL COMPANIES AND EVALUATION OF DEBT SUBMERGENCE

TİCARİ İŞLETMELERDE İFLASIN ERTELENMESİNDE İYİLEŞTİRME SÜRECİ İLE BORCA BATIKLIK TESPİTİNE YÖNELİK DEĞERLENDİRME

Abstract

The postponement of bankruptcy is situated in Bankruptcy Law. The postponement of bankruptcy is one of the types of insolvency proceedings and is only a postponement. It is not an enforcement tool. If a number of conditions are fulfilled (in addition to being submerged in debt, a comprehensive financial analysis made, acceptable and honest recovery project), postponement decision can be made by the bankruptcy court. In this study, the recovery and healing process in the company's bankruptcy is explained and a sample expert report is given.

İflasın ertelenmesi kurumu, İcra ve İflas Hukuku içerisinde yer almaktadır. İflasın ertelenmesi, iflas davası türlerinden biri olup sadece bir ertelemedir, bir cebri icra aracı değildir. Bir takım şartların yerine getirilmesi halinde (borca batık olma ile kabul edilebilir kapsamlı mali analizi yapılmış dürüst bir iyileştirme projesi) iflas kararının mahkeme tarafından ertelenmesidir. Bu çalışmada işletmelerde iflasın ertelenmesinde iyileştirme ve iyileştirme süreci anlatılıp, konu güncel örnek bilirkişi raporu ile anlatılmaya çalışılmıştır.
