Özet
Hukuka aykırı eylem sorumluluğunda Türk/İsviçre Borçlar Hukuku kural olarak zararı veren kişinin kusurlu olmasını aramıştır. Bunun için buna kusur sorumluluğu adı da verilmiştir. Bunun yanısıra sorumluluk için kusurun aranma dığı durumlar da vardır, buna da kusursuz/netice/sebep sorumluluğu denilir. 6098 sayılı yeni Türk Borçlar Kanunu hazırlanmadan evvel, Türk öğretisi kusursuz sorumluluğun iki yaygın türünü kabul etmişti. Bunlardan birincisi «hâkimiyet ve yararlanma» esasına dayanan kusursuz sorumluluk halleri ve diğeri de «tehlike» esasına dayanan kusursuz sorumluluk halleriydi Tehlike esasına dayanan kusursuz sorumluluk hallerinde ise, sorumlu kişiy e sorumluluktan kurtulması için herhangi bir olanak tanınmamaktadır. Bu nedenle doktrinde tehlike sorumlulukları için ağırlaştırılmış sebep sorumluluğu terimi de kullanılmaktadır Bu çalışmada tehlike sorumluluğuna ilişkin 6098 sayılı Türk Borçlar Kanununun getirdiği yeni yasal düzenlemeler incelenmiştir. Ayrıca, Bu konuya ilişkin karşılaştırılmalı hukuktaki düzenlemeler ele alınmış ve Avrupa Birliği Hukuku İlkeleri değerlendirilmiştir.
Abstract
With respect to the liability for unlawful action, Turkish / Swiss Code of Obligations, as a rule, requires that the p erson causing the damage be held liable. Therefore it is also called f ault liability . In addition thereto, there are circumstan ces under which the f ault is not required f or being held liable; this is called nof ault/ consequence/cause liability . Prior to the drawing up of the new Turkish Code of Obligations no. 6098, the Turkish doctrine acknowledged two common types of no-fault liability. The first one relates to the circumstances of no-fault liability which is based upon «dominance and enjoyment» and the other one relates to the circumstances of no-fault liability which is based upon the principle of «danger» In the case of circumstances of nof ault liability which is based up on the p rin cip le of danger, the liable p erson is not granted any remedy to relieve f rom the lia bility. Theref ore, in the doctrine the term aggravated cause liability is also used f or danger liabilities The present study discusses the new legal provisions introduced by the Turkish Code of Obligations no. 6098 regarding the danger liability. The study further discusses the comparative legal arrangements in relation to the subject hereof and considered the Legal Principles of the European Union.
