Özet

İş Sağlığı ve Güvenliği Kanunu, işveren ile çalışanların hak ve yükümlülüklerini düzenlemektedir. Bu yapısı, işyerlerinde ortaya çıkan iş kazaları ve meslek hastalıklarında sorumlunun belirlenmesine yardımcı olmaktadır. Aynı yasa, sorumlunun belirlenmesi sonrasında, onun kusur düzeyinin tespit edilebilmesini de sağlamaktadır. Bu çalışmada, 6331 sayılı yasada düzenlenen yasal yükümlüklerden, uygulamada en sık sorumluluk sebebi olanlar üzerinde durulmaktadır.

Abstract

The Law of Occupational Safety and Health prescribes the employers and the employees rights and obligations. Thus, it helps to determine the responsibility for the occupational accident and diseases. The law also helps to determine the level of the legal negligence. In this article, the most important obligations of the employer, which are prescribed in the law, no. 6331 and mostly the causes of the responsibility are to be examined.
