Abstract

This essay contains a brief summary of legislative history of mo-dern law of civil procedure of Turkey. Since 1948 six different drafts were prepared for a new code of civil procedure to replace the Code of Civil Procedure of 1927. Finally, a new Code of Civil Procedure was adopted in January 2011. The new Code entered into force on October 1, 2011. The essay compares the new Code with the previous draft laws.

1927 yılına ait HUMK‟nun yerine yeni bir medeni usul kanunu yapmak amacıyla 1948 yılından beri altı farklı tasarı hazırlanmıştır. So-nunda, hazırlık çalışmaları 2006 yılında tasarı, yeni Hukuk Muhakeme-leri Kanunu olarak kabul edilmiştir. Makalede, bu (eski) tasarılar ince-lenmekte ve yeni Kanun ile karşılaştırılmaktadır.
