Abstract
Jurisdiction of courts is restricted in different ways regarding some various factors. Besides restrictions such as branches of judiciary, jurisdiction with respect to subject matter or territory, there is another restriction, which is under-researched in Turkish law but accepted in some foreign law systems, called function. In this sense, a court or a judicial body must also be functionally authorized to exert jurisdiction over a concrete procedural action. Otherwise, despite that judicial body has jurisdiction with respect to subject matter and territory, that concrete procedural demand cannot be heard and determined by the same judicial body. Such as the relationship between courts of first instance and courts of appeal as well as among different courts of appeal, the relationship between an associate judge (who has jurisdiction to decide by his own in different situations) and committee, the relationship between arbitration committee for consumer problems and consumer courts, the relationship between the judicial authorities that has jurisdiction to decide about the disqualification of a judge could be seen as examples for the restriction of judicial power by function. In Turkish law, although there is not any special provision related to functional jurisdiction of courts, it can be suggested that the provisions related to jurisdiction of the courts with respect to subject matter could be applied by analogy. However, in order to reduce possible problems and avoid from vagueness it will be appropriate to regulate functional jurisdiction of courts explicitly.
Özet
Mahkemelerin yargı yetkisi çeşitli hususlar göz önüne alınarak ve çeşitli şekillerde sınırlandırılmıştır. Yargı yolu, görev, yetki gibi sınırlamaların yanında karşılaştırmalı hukukta kabul görmesine rağmen Türk hukukunda henüz üzerinde yeterince durulmamış diğer bir sınırlama olarak mahkemenin işlevi söz konusudur. Buna göre, bir mahkeme veya yargısal organ söz konusu somut usûlî işlem bakımından işlevsel olarak da yetkili olmak zorundadır. Aksi hâlde, genel anlamda görev ve yetki gibi sınırlamalar aşılsa dahi, o işlemin o mahkeme veya yargısal organın işlevine girmediği kabul edilmelidir. Farklı derece mahkemeleri arasındaki ilişki, toplu mahkemelerde heyet ile hâkim arasındaki ilişki, tüketici hakem heyeti ile tüketici mahkemesi arasındaki ilişki ve hâkimin reddi talebi hakkında karar verebilecek merciiler arasındaki ilişki gibi durumlar mahkemelerin işlev yönünden sınırlamalarına örnek olarak gösterilebilir. İşlev kurallarının incelenmesi ile hüküm ve sonuçları hakkında hukukumuzda özel düzenlemeler yer almamakla birlikte, bu konuda genel olarak görev kurallarına ilişkin düzenlemelerin uygulanabileceği ileri sürülmektedir. Ancak, muhtemel sorunları en aza indirgemek ve belirsizlikleri gidermek adına işlev kurallarına ilişkin açık hükümler öngörülmesi yerinde olacaktır.
