THE ISSUE OF POSSIBLE LIMITATION OF EVIDENCE UPON THE ADDUCTION OF EVIDENCE DURING THE EXCHANGE OF MOTIONS

Abstract
Based on the principle of being prepared by parties proficient in law of civil procedure, evidence should be properly adduced to the court. However, the procedural period to adduce evidence is limited to the exchange of motions by the law. After this phase, it is not possible to adduce new evidence if it is not adduced based on any exception recognized in the Law. Limitation of evidence, i.e. adduction of all the evidence to prove plaintiff’s and defendant’s cases based on their complaint and answer, and the statement that they have no further evidence to show, is a concept commonly debated as being associated with the period when the evidence should be filed. This study explores the concepts of period to adduce evidence and limitation of evidence, and the relationship between these two concepts.
Özet
Medenî usûl hukukuna hakim olan taraflarca getirilme ilkesi gereği; delillerin kural olarak taraflarca gösterilmesi gerekir. Ancak kanunî düzenlemelerle, yargılamada tarafların delillerini göstermesi gereken usûlî kesit dilekçelerin değişimi aşaması ile sınırlandırılmıştır. Bu aşamadan sonra ise Kanun'da gösterilen istisnalar dışında taraflarca yeni delil gösterilmesi mümkün değildir. Tarafların iddialarının ve savunmalarının temelini oluşturan vakıalarının ispatı için gereken bütün delillerini göstermeleri ve başka delilleri olmadığını belirtmeleri anlamına gelen delillerin hasredilmesi kurumu, öğretide delillerin kanunen gösterilmesi gereken zaman ile ilişkilendirilerek tartışmalara sebep olmuştur. Bu çalışmada ise delillerin gösterilme zamanı, delillerin hasredilmesi ve bu iki kurum arasındaki ilişki incelenmeye çalışılacaktır.
