LEGAL STATUS OF THE FAMILY EXPERTS IN FAMILY COURTS AND DENIAL OF THESE EXPERTS

Abstract

According to Article 4 of the Law No. 4787 on the Establishment, Duties and Trial Procedures of Family Courts (Family Courts Act) the lawsuits and works arising from the family law in the second book of the Turkish Civil Code and the protection of the family, excluding disputes related to guardianship. and in order to protect the family under Law No. 6284, Articles 4 and 5 of the Law on the Prevention of Violence Against Women, it is the duty of the family court to make various protec-tive and preventive decisions and to examine the objections against the decisions made under this law. To report the results of the family courts by conducting research and examination on the reasons for dispute between the parties about the issues requested by the court, during the proceedings, before ente-ring the merits of the case or during the trial, while carrying out the ca-ses and works assigned by the Laws itself; if the court deems it neces-sary, to be present at the hearing, to carry out studies on the desired issues and to express opinions; finally, preferably to perform other du-ties to be assigned by the court; It is accepted that among the ones who are married and have children, who are over thirty years old and who have completed postgraduate education in the field of family problems, the experts assigned in the courthouses by the Ministry of Justice will be used (Family Courts Act, Art. 5 / f. 1). However, the legal nature of these experts is controversial in doctrine and jurisprudence. On the other hand, the refusal of these experts to ensure their impartiality within the scope of the task assigned to him is important. In this study, the legal status and denial of experts appointed in family courts will be examined.

Özet

4787 sayılı Aile Mahkemelerinin Kuruluş, Görev ve Yargılama Usullerine Dair Kanun’un 4’üncü maddesine göre, “vesayet” ile ilgili uyuşmazlıklar hariç olmak üzere, Türk Medeni Kanunu’nun ikinci kita-bında yer alan aile hukukundan kaynaklanan dava ve işler ile 6284 sayılı Ailenin Korunması ve Kadına Karşı Şiddetin Önlenmesine Dair Ka-nun’un 4 ve 5. maddesi kapsamında ailenin korunması bakımından, çe-şitli koruyucu ve önleyici kararlar verilmesi ve 9. maddeye göre de bu kanun kapsamında verilen kararlara karşı yapılan itirazları incelemek aile mahkemesinin görevidir. Aile mahkemelerinin, Kanunların kendisini görevlendirdiği dava ve işleri yürütürken bünyesinde, davanın esasına girilmeden önce veya davanın görülmesi sırasında, mahkeme tarafından istenen konular hak-kında, taraflar arasındaki uyuşmazlık nedenlerine ilişkin araştırma ve inceleme yaparak sonucunu bildirmek; yine mahkemenin gerekli gördü-ğü hâllerde duruşmada hazır bulunmak, istenilen konularla ilgili çalış-malar yapmak ve görüş bildirmek; son olarak mahkemece verilecek di-ğer görevleri yapmak, üzere tercihan; evli ve çocuk sahibi, otuz yaşını doldurmuş ve aile sorunları alanında lisansüstü eğitim yapmış olanlar arasından Adalet Bakanlığı tarafından adliyelerde görevlendirilen uz-manlardan yararlanılacağı kabul edilmiştir (Aile Mah. K. m. 5/f. 1). An-cak bu uzmanların, hukuki niteliği doktrin ve yargı içtihatlarında tartış-malıdır. Öte yandan, bu uzmanların kendisine verilen görev kapsamında tarafsızlığını sağlamaya yönelik olarak reddi önem arz etmektedir. Bu çalışmada, aile mahkemelerinde görevlendirilen uzmanların hukuki sta-tüsü ve reddi incelenmeye çalışılacaktır.
