THE TRANSFORMATION OF COMMON LANDS INTO PRIVATE PROPERTY ?: A COMPARISON OF THE BRITISH ENCLOSURE MOVEMENTS AND THE LAND CODE OF 1858 IN THE OTTOMAN EMPIRE

Abstract

In this article, it is aimed to make a comparison between the example of the capitalist mode of production and the modern state first emerged in terms of the development of common land as a private property and the Ottoman where this transition took place in a different time and at a different time. The emergence of land as a property subject led to the the confiscation of non-private lands; both processes proceeded in parallel. While British enc-losure movement is recognized as a process the original instance of the first, the case of Ottoman in the process generally is begun with the Land Code of 1858. However, when the text of the law regulating the miri land regime is examined, it has been observed that the legal status of these lands has been strengthened instead of making the miri lands as private property, to-gether with the lands of metruk and the mevat. The phenomenon of the spread of absolute private property in the land, which is an important step in the formation of the modern state, starting with the British enclosure movements and for Ottoman this movement can not be started with Land Code of 1858.

Özet

Bu makalede, ortak toprakların özel mülk konusu haline gelişi açısından ka-pitalist üretim biçimi ve onun tamamlayıcısı olan modern devletin ilk ortaya çıktığı İngiltere örneği ile bu geçişin farklı bir biçimde, farklı bir zamanda ger-çekleştiği Osmanlı arasında Arazî Kanunnâmesi çerçevesinde bir karşılaş-tırma yapılması hedeflenmiştir. Toprağın özel mülk konusu haline gelmesi, aynı zamanda özel mülk olmayan topraklara el konulmasına yol açmış; iki süreç birbirine paralel olarak ilerlemiştir. İngiliz çitleme hareketleri bu süre-cin ilk ve özgün örneğini oluştururken Osmanlı açısından sürecin genel ola-rak Arazî Kanunnâmesi ile başladığı kabul edilmektedir. Oysa miri toprak re-jimini düzenleyen kanunname metni incelendiğinde, metruk ve mevat ara-ziler ile birlikte miri arazilerin özel mülk haline getirilmediği; aksine bu top-rakların özel mülkiyet konusu olmayan hukuki statülerinin sağlamlaştırıldığı gözlemlenmiştir. İngiliz Çitleme hareketleri ile başlayan ve modern devletin oluşumunda önemli bir adım olan toprakta mutlak özel mülkiyetin yaygın-laşması olgusu, Osmanlı açısından Arazi Kanunnâmesi ile başlatılabilir bir ni-telikte değildir.
