APPEAL PROCEDURE IN ADMINISTRATIVE JURISDICTION: APPEAL OR OPPOSITION?

Abstract
The appeal procedure entered into force on 20.7.2016 in parallel with the launching of appeal courts. After the appeal procedure, Turkish administrative jurisdiction has become three-layered system, however it is not possible to say that all the cases would pass through all three lay- ers. The three-layered system is applicable for only some limited cases. Given that the way of examinations followed by appeal and oppo- sition procedures and contents of judgments given by both procedures are identical, the so-called appeal reform did not actually abrogate the opposition procedure but, on the contrary, expanded it under the name of appeal. The appeal procedure, as it stands, poses problems. First of all, confining cassation court’s authority to a narrow area will create con- sistency problems. The High Administrative Court will not be able to express directly its opinion for a great deal of cases and it is uncertain how productive the procedure of unification of judgments will be. Sec- ondly, among the administrative jurisdiction system only Council of State’s judgments are accessible via Journal of Council of State or legal databases. After the appeal procedure, a great deal of judgments, which are final and fall outside the jurisdiction of Cassation Court, will be close to public access. Besides, for the reason that the opposition court for the decision of the suspension of execution and the appellate court will be same court, the court of first instance will feel obliged to pay regard to the opposition court’s decision. Finally, the reasons to remand a judgment, which are enumerated in the law, should be amended. Be- cause the appellate courts do not obey this rule in practice and expand de facto the list of reasons to remand.
Özet
2014 yılında 6545 sayılı Kanunla İdari Yargılama Usulü Kanu- nu’nda yapılan değişiklikle idari yargı mevzuatına giren istinaf kanun yolu, 20.07.2016 tarihinde istinaf mahkemelerinin faaliyete geçmesiyle birlikte yürürlüğe girmiştir. İstinaf kanun yolu ile idari yargı sistemi üç dereceli bir görünüme kavuşmakla birlikte, açılan tüm davaların bu üç derecenin her birinden geçebileceğini söylemek mümkün değildir. Üç dereceli yargılama yalnızca sınırlı sayıda dava için geçerli olacaktır. İstinaf kanun yolu ile yürürlükten kaldırılan itiraz kanun yolu kar- şılaştırıldığında ise gerek takip edilen usul gerekse inceleme sonrası ve- rilebilecek kararlar arasında bir ayniyet göze çarpmaktadır. Dolayısıyla yapılan istinaf reformunun aslında itiraz kanun yolunu ilga etmediği, aksine istinaf adı altında genelleştirdiği ifade edilebilir. İstinaf sisteminin mevcut halinde problemli birkaç husus yer al- maktadır. Öncelikle yeni sistemde temyize tabi kararların sınırlılığı, pek çok konuda Danıştay’ın meselelere bakış açısını görmemizi engelleye- cek ve içtihat birliği açısından da sorun yaratacaktır. İkinci olarak, idari yargı kararlarından yalnızca Danıştay kararlarına Danıştay Dergileri veya içtihat veri bankaları yoluyla erişilebilmektedir. İstinaf sistemiyle birlikte, temyize kapalı pek çok karar kamuoyunun bilgisine de kapalı kalacaktır. Ayrıca yürütmenin durdurulması kararlarının itiraz merci ile istinaf merciinin örtüşmesi nedeniyle ilk derece mahkemeleri esas hak- kında karar verirken bölge idare mahkemesinin yürütmenin durdurulma- sına itiraz aşamasındaki görüşünü göz önünde bulundurma eğilimi göste- rebilir. Zira itiraz aşamasında verilen karar istinaf aşaması için bir tür ihsas-ı rey niteliğinde olacaktır. Son olarak, istinaf mahkemesinin huku- ka aykırı bulduğu ilk derece mahkemesi kararlarından hangilerini geri gönderebileceği kanunda sayılmıştır. Bu nedenle geri gönderme halleri- nin yeniden düzenlenmesi gerekmektedir.
