Restrictions on Polygamy in Contemporary Islamic Legislation

Abstract
The permission to marry up to four women as accepted in classical Islamic law has been subject to a restrictive approach in most Islamic family laws introduced lately. These restrictions have been in the form of putting extra conditions for the additional marriage and making it subject to review by a judge. Even though these conditions vary from country to country, the common ground is the search for a legitimate reason for polygamy (taaddudu zawjaat). In general, this reason is related to the current marriage being unable to realize the objectives of marriage. In such a situation, from among the two alternatives of divorce and polygamy the latter is thought to be better in terms of protecting the interests of both sides. Because a woman having multiple husbands (polyandry) is regarded as in conflict with Islamic values, the only option is to go for one of the ways of divorce. The fact that restrictive Islamic family laws requires from the husband capability in terms of wealth, justice among wives, legitimate reason, the consent of the current wife, and informing the future wife about the existence of a prior marriage aims to ensure that polygamy is not abused, to establish peace and justice within the family, and protecting the rights of women and children.

Klasik İslam hukukunda kabul gören dörde kadar kadınla evlenme izni, son zamanlarda yürürlüğe konulan İslam aile hukuku kanunlarının çoğunda sınırlandırıcı bir yaklaşıma konu olmuştur. Sınırlandırmalar ilave evliliği bir takım şartlara bağlama ve hâkim denetimine tabi tutma şeklinde gelişmiştir. Sınırlandırıcı şartlar ülkelere göre değişmekle birlikte ortak zemin çok eşliliğin (taaddüdü zevcât) meşru bir gerekçeye dayanmasıdır. Genel anlamda bu gerekçe mevcut evlilikle evliliğin amaçlarının gerçekleştirilemiyor olmasıdır. Böyle bir durumda boşanma veya erkeğin ilave bir kadınla evlenmesi alternatiflerinden ikinci şıkkın tarafların maslahatını daha iyi koruduğu kabul edilerek çok eşliliğe izin verilmektedir. Aynı durumda kadın için tek seçenek boşanma usullerinden birine başvurmaktır. Çok kocalılık (poliandri) İslami değerlere aykırı görüldüğü için hiç söz konusu edilmemiştir. Sınırlandırıcı yaklaşımı benimseyen İslam aile hukuku kanunlarında çok eşliliğe izin vermek için kocaya; maddi yeterlilik, eşler arasında adalet, meşru gerekçe, mevcut hanımın onayını alma, müstakbel hanıma evli olduğunu bildirme gibi şartlar koşulması bu iznin istismar edilmesini engellemeyi, ailede huzur ve adaletin sağlanmasını, kadınların ve çocukların haklarının korunmasını amaçlamaktadır.
