THE PRICE REDUCTION RIGHT UNDER THE TURKISH CODE OF OBLIGATIONS DUE TO DEFECTIVE GOOD

TÜRK BORÇLAR KANUNU UYARINCA SATIŞ SÖZLEŞMESİNDE AYIP NEDENİYLE BEDELDE İNDİRİM HAKKI

Abstract

This study deals with the issue of buyer’s right to resort to Art. 227 of the Turkish Code of Obligations no.6098 that govern the principle of price reduction among other remedies in case of a contractual breach. The purpose of this study is to elaborate on the nature, scope and outcome of price reduction in the light of Supreme Court’s decisions. For the sake of a better understandig of the matter at hand, a comparison is introduced between current and former regulations of the Turkish Law.

Özet

6098 sayılı Türk Borçlar Kanunu’nun 227. maddesinde satıcının ayıp nedeniyle sorumluluğu neticesinde alıcının sahip olduğu seçimlik hakların neler olduğu belirtilmiştir. Çalışmamızda alıcının sahip olduğu bu seçimlik haklardan, satış sözleşmesine konu olan malın bedelinde indirim hakkı incelenecek olup, bu doğrultuda öncelikle farklı teorilere de yer verilerek bu hakkın hukuki niteliği ve bedelde indirimin ne şekilde yapılacağı Yargıtay kararları ışığında değerlendirilecek, daha sonra da bu hakkın kullanılmasının sınırları ve sonuçları 818 sayılı Borçlar Kanunu ile karşılaştırmalı olarak ayrıntılarıyla irdelenecektir.
