EFFECTS OF INCOMPETENCE TO CONCLUDE A COLLECTIVE LABOUR AGREEMENT IN TURKISH COLLECTIVE LABOUR LAW

Abstract
It is possible to define a collective labour agreement as an agreement signed between a trade union and an employer's union or an employer who is not a member of employer's union in order to regulate matters related to the construction, content and termination of the employment agreement. It is necessary to have a certificate of authority in order to be able to conclude a collective labour agreement, but before having a certificate of authorization, the parties of the collective agreement must be competent to conclude a collective labour agreement. According to Article 53 of the Constitution dated 1982 the right to conclude a collective labour agreement by employees and employers, unlike the Constitution it is regulated that this right shall be used only by the trade unions according to the Act numbered 6356. According to the Law trade unions, employers and employer's unions have a competence to conclude a collective labour agreement. In law, legal consequences of a collective labour agreement signed without an authorization certificate are regulated, but it is not possible to find a regulation that regulates the legal consequences of a collective labour agreement signed without competence. This lack of provision causes disputes in doctrine. In this case, the basic principles of law shall be used to solve the problem. In this study, the concept of the collective labour agreement has been considered and the competence to conclude a collective labour agreement has been examined in detail in terms of trade union, employer's union and employer. The conditions, which causes incompetence, have been examined one by one within the relation between competence and authority to conclude collective labour agreement and the impact of incompetence on collective labour agreement has been stated.

Toplu iş sözleşmesi iş sözleşmesinin yapılması, içeriği ve sona ermesine ilişkin hususları düzenlemek üzere işçi sendikası ile işveren sendikası veya sendika üyesi olmayan işveren arasında yapılan sözleşme olarak tanımlanmaktadır. Toplu iş sözleşmesi bağıtlayabilmek için yetki belgesine sahip olmak gerekir ancak yetki öncesinde toplu iş sözleşmesi ehliyetinin varlığı aranır. 1982 Anayasasının 53. maddesinde işçiler ve işverenlere tanınan toplu iş sözleşmesi yapma hakkı 6356 sayılı Yasada işçiler bakımından sadece işçi sendikalarına tanınmıştır. Yasa uyarınca işçi sendikaları, işveren veyahut işverenin sendika üyesi olması durumunda işveren sendikası toplu iş sözleşmesi ehliyetine sahiptir. Yasada yetkisiz akdedilen toplu iş sözleşmesinin akıbetine ilişkin bir düzenleme yer almakla birlikte ehliyetsizliğin toplu iş sözleşmesi üzerindeki etkisine ilişkin bir hüküm bulunmamaktadır. Bu durum doktrinde tartışmalara neden olmakla birlikte hukukun genel ilkeleri çerçevesinde sonuca varılabileceğini ifade etmek mümkündür. Bu çalışmada, toplu iş sözleşmesi kavramı ele alınmış ve toplu iş sözleşmesi ehliyeti işçi sendikaları, işveren sendikaları ve işveren bakımından ayrıntılı olarak incelenmiştir. Ehliyet ve yetki ilişkisine yer verilen çalışmamızda ehliyetsizlik halleri tek tek ele alınmış ve ehliyetsizliğin toplu iş sözleşmesi üzerindeki etkisi değerlendirilmiştir.
