Abstract

Peculium arrangement was a significant institution in Roman economic life. It had also an important place in Roman family. According to the customs and laws of Roman society, slaves were not considered as persons. Also sons and slaves were incapable of having rights and gettinginto debts. Due to the advantages brought by peculium, slaves and sons could join Roman commercial life and be an active factor in the economy. Direct agency did not exist in Roman law. The only legal agency form was indirect agency. The activities of the slaves and sons with peculium, fulfiled the need of direct agency in Roman society. Economic necessities stipulate that more people join commercial life. Hence, masters and fathers gave their slaves and sons a capital and made them a part of commercial life. This study's main focus points are the effects of peculium on slaves, sons and third parties in Roman economic life. According to this, in the study firstly a brief definition of peculium has been given, then the characteristics of peculium have been explained and lastly the effects of peculium on slaves, sons and third parties have been discussed concisely.

Özet

Peculium Roma ekonomik ve aile hayatında büyük önem taşıyan bir kurumdur. Roma hukukunda mal statüsünde sayılan köleler ile hak ehliyetine sahip olmayan ve dolayısıyla haklara ehil olmayan aile evlatları hukuken kişi sayılmıyordu. Doğrudan temsilin kabul edilmediği ve ekonomik gereksinimlerin ticaret hayatına daha fazla kişinin katılmasını şart kıldığı noktada efendi ya da aile babası köle ya da aile evladına verdiği peculium adı verilen bir sermaye ile onları ticaret hayatına katardı. Peculium'un sağladığı avantajlarla birlikte köleler ve aile evlatları ticaret hayatına katılabiliyor ve ekonomide söz sahibi olabiliyorlardı. Bu çalışmada peculium'un tanım ve özelliklerinden kısaca bahsedilmiş, özellikle Roma ekonomik hayatında peculium'un köleler, aile evlatları ve üçüncü kişiler açısından etkileri üzerinde durulmuştur.
