PROVIDING FALSE INFORMATION IN THE COURSE OF ISSUING AN OFFICIAL DOCUMENT (TCC ART.206)

Abstract

By the crime of “Providing False Information in the Course of Issuing an Official Document” under the article 206 of the Turkish Criminal Code, any person who provides false information to a public officer who has the authority to issue an official document is punished. Untrue declaration often occurs in the form of providing false information on identity information. Therefore, it is required to evaluate the nature of the act of untrue declaration on the identity, in terms of the crime of providing false information in the course of issuing an official document, the crime of using other’s identity card or ID information and the nonnotification the identity prescribed in Law of Misdemeanors. This issue is particularly addressed in the article. In this article, the crime of providing false information in the course of issuing an official document is examined taking into consideration the decisions of the Supreme Court.

Özet

Türk Ceza Kanunu’nun 206. maddesinde düzenlenen resmi belgenin düzenlenmesinde yalan beyan suçu ile bir resmi belgeyi düzenlemek yetkisine sahip olan kamu görevlisine yalan beyanda bulunan kişi cezalandırılmaktadır. Yalan beyanda bulunma, genellikle kimlik bilgilerine ilişkin gerçek dışı bilginin bildirilmesi şeklinde gerçekleşmektedir. Bu nedenle kimlik bilgilerine ilişkin yalan beyanda bulunma eyleminin niteliğini, resmi belgenin düzenlenmesinde yalan beyan suçu, başkasına ait kimlik ve kimlik bilgilerini kullanılması suçu ile Kabahatler Kanununda öngörülen kimliği bildirmeme kabahati açısından değerlendirmek gerekmektedir. Bu husus, makalede özel olarak ele alınmaktadır. Bu makalede resmi belgenin düzenlenmesinde yalan beyan suçu, Yargıtay kararları dikkate alınarak incelenmektedir.
