ANCIENT GREEK ORIGINS OF CONSTITUTIONALISM: THE CORRELATION AMONG PUBLIC SPHERE, POLITICS AND LAW

Abstract

The concept of constitution was created in the West in the late 18th century to provide a response to constitutional pursuits that are as old as the history itself. We can follow the origins of constitutionalism - that which is universal in character- until the ancient Greek world. Furthermore, with its fundamental civic ethos and the distinctive constitution of the polis, this world has provided many philosophical-scientific concepts and political-legal institutions that are still in widespread use to day. As polis -as a macro public sphere- was the battleground for power struggle between the privileged rich and the poor classes, the question of justice, which initially had metaphysical associations, transformed into a constitutional issue. The resolution of this problem could be possible with such laws that are products of direct political action. Of course, a never-ending debate regarding what is just and how the political-legal sphere should be organized had never ceased to exist. To reflect upon such qualities of ancient Greek constitutionalism -whilst keeping in mind of our own distinct context- may provide us a new/renewed perspective on how to tackle our own contemporary constitutional issues such as constitutional and democratic regression.

Özet

Anayasa kavramı Batı’da 18. yüzyılın sonunda tarih kadar eski anayasal arayışlara bir yanıt olarak türetilmiştir. Bu evrensel nitelikli anayasalcılık düşüncesinin kökenlerini Antik Yunan dünyasına değin izleyebiliriz. Dahası, başat kamusalcı karakteri ve polis’in kendine özgü yapısıyla Antik Yunan dünyası, bugün kullandığımız birçok felsefî bilimsel kavram ve politik-hukukî kurum ortaya çıkartmıştır. Bir makro kamusal alan olarak polis’in ayrıcalıklı zengin sınıf ile yoksul sınıf arasında sürekli bir iktidar mücadelesine sahne olması daha önce metafizik çağrışımları olan adalet sorununu bir anayasal sorun kılmıştır. Bu sorunun çözümlenmesi, politik eylem alanının ürünü olan hukukla mümkün olabilirdi. Pek tabiî ki, neyin adil olduğu ve politik-hukukî alanın nasıl düzenlenmesi gerektiğiyle ilgili bitmek bilmeyen bir tartışma da mevcuttu. Antik Yunan anayasalcılığının böylesi niteliklerini ele almak, bugün kendi özgün bağlamımızda karşılaştığımız demokratik ve anayasal gerileme sorunlarıyla nasıl başa çıkılabileceği hususunda bize yeni/yenilenmiş bir bakış açısı sağlayabilir.
