Public Communication and the Right to Information in Turkey: A Panoramic Review after the Ten Years Experiences

Abstract
Abstract: The nature of the relationship between the ruler and the ruled, how this rela- tionship should be, and also the nature and features of government-citizen communica- tion in the modern state structure have been subjects of many studies. The right to in- formation, on the one hand, has important ties with the freedoms of thought and expres- sion, and on the other hand, is closely related with the right to require of every public agent an account of her/his administration. The right to information comes to the fore with the aim to serve publicity of acts and actions of political power as a public body and to make available the transformation of these acts and actions by the governed. In Turkey, the practices related with the right to information, as the instrument of making the acts and actions of the state public, came to the agenda on the eve of 2000s, and as of 2014, and now, they are 10 years old. In the article, the right to information prac- tices will be analyzed by considering the first ten years period of the practices, and also regarding the worldwide experiences and discussions around the issue.

Özet: Yöneten-yönetilen arasındaki ilişkilerin doğası, nasıl olması gerektiği, modern devlet yapısı içinde devlet-yurttaş iletişiminin niteliği ve özellikleri, birçok çalışmaya konu olmuştur. Bilgi edinme hakkı, bir yandan düşünce ve düşünceyi açıklama özgürlü- ğüyle diğer yandan yurttaşın yönetimden hesap istemesi hakkıyla yakından bağlantılı- dır. Söz konusu hak, kamusal bir niteliği olan siyasal iktidarın kendi eylem ve işlemleri- ni yönetilenlerin bilgisine açması, kamusal politikaların yönetilenler tarafından değişti- rilip dönüştürülebilmesi amacına yönelik olarak gündeme gelmektedir. Türkiyede bir kamu otoritesi olarak devletin, eylem ve işlemlerini Kamuya açmasının bir aracı ola- rak bilgi edinme hakkı uygulamaları, 2000li yılların başında gündeme gelmiştir ve ar- tık 10 yaşındadır. Makalede, bilgi edinme hakkı uygulamalarının Türkiyedeki on yıllık serüveni, dünyadaki uygulama örneklerinden ve tartışmalardan da yararlanarak pano- ramik biçimde incelenecektir.
