Right to Correspondence in the Light of Comparative Judicial Decisions

Abstract

As is known, the right to correspondence has been an area where public authorities have intervened more with the nascent technology in the last 50 years. Therefore, considering that these developments and interventions have increased, it is not a coincidence that countries enact provisions such as interception or detection of communication to their criminal laws. One of the main interventions in question is the prevention / censorship of correspondence.Therefore, although the right to correspondence is examined in this study, the intervention dimension of the decisions of the Turkish Constitutional Court (AYM), the European Court of Human Rights (ECtHR) and the United States (US) Supreme Court have been studied comparatively.

Özet

Haberleşmeye saygı hakkı bilindiği üzere son 50 yılda teknolojinin de büyük bir ivme kazanmasıyla birlikte kamusal makamların daha fazla müdahale ettiği bir alan olmuştur. Bu nedenle, söz konusu gelişmelerin ve müdahalelerin arttığı düşünülürse ülkelerin ceza kanunlarına iletişimin dinlenmesi veya tespit edilmesi şeklindeki hükümleri eklemeleri tesadüf değildir. Söz konusu müdahalelerin başında mektuplaşmaların engellenmesi/sansürlenmesi gelmektedir. Bu nedenle, bu çalışmada haberleşmeye saygı hakkı incelenmişse de bu hak karşılaştırmalı olarak Anayasa Mahkemesi (AYM), Avrupa İnsan Hakları Mahkemesi (AİHM) ve ABD (Amerika Birleşik Devletleri) Yüksek Mahkemesi kararlarının mektuplara müdahale boyutu incelenmiştir.
