The Public Procurement Law: Transparency and Competition

Abstract
The article discusses mainly the Public Procurement Law under the light of transparency and competition concepts in Turkey. As it is known that corruption is an universal problem that is possible to be seen in most of the developed and developing countries all over the world. There are lots of factors that affect each other in emerging the corruptions in the developing countries. Absolutely, one of the important reasons that is effectful in emerging and prevailing corruptions is the lack of legal regulations. Turkish Grand National Assembly has enacted the 4.1.2002 dated and 4734 numbered "Public Procurement Law" (PPL) for the aim of a transparent and competitive collection by getting better the public procurement system. While preparing the law, EU Directives and UNCITRAL model Law Regulations have been taken as an example. In this study, PPL has been regarded by taking point views of the basic principles of procurement jurisdiction such as transparency, competitiveness and being executable. The law will provide positive supports to the completion process of adaptation to the EU and decreasing the corruption to the possible lowest level in public procurements by providing transparency and competition. However, the law is not sufficient by the views of transparency, competition and being executable in public procurements at whole. There is need to make some additional regulations to support that law. So finally such a point has been reached that, the law as the only instrument is not sufficient by the views of transparency, competition and being executable in public procurements at whole. There is need to make some additional regulations to support the law.
Özet
Yolsuzluk, gelişmiş ve gelişmekte olan ülkeler dahil olmak üzere günümüzde ülkelerin çoğunda görülebilen evrensel bir problemdir. Gelişmekte olan ülkelerde sıklıkla görülen yolsuzlukların ortaya çıkmasında bir birini sürekli etkileyen bir çok faktör rol oynamaktadır. Kuşkusuz yolsuzlukların ortaya çıkmasında ve yaygınlaşmasında önemli nedenlerden biri de yasal düzenlemelerin yetersizliğidir. Türk kanun koyucusu, kamu ihale sisteminin iyileştirilerek şeffaf ve rekabetçi bir mevzuatın oluşturulabilmesi amacıyla 4.1.2002 tarih ve 4734 sayılı "Kamu İhale Kanunu" yapmıştır. Kanunun hazırlanmasında AB Direktifleri ve UNCITRAL Model Kanunu düzenlemeleri örnek alınmıştır. Bu çalışmada, Kamu İhale Kanunu, ihale hukukunun temel ilkeleri olan açıklık (şeffaflık), rekabetçi ve icra edilebilirlik açısından değerlendirilmiştir. Kanun, gerek AB 'ye uyum sürecinin tamamlanması ve gerekse kamu ihalelerinde açıklık ve rekabetin sağlanarak yolsuzlukların en aza indirilmesi açısından olumlu katkıda bulunacaktır. Ancak kanun, kamu ihalelerinde açıklık, rekabet ve icrailik açısından yetersizdir. Ek düzenlemelerin yapılması gerekir.
