Some Thoughts on the Improvement in the Reconstruction Laws for the Cities

Abstract

This article examines the Laws on the (Cities') Reconstruction which had been proclaimed since the beginning of the Republican Era in Turkey. The author's fixing is that all the Laws became unsuccessful in settling developed cities. So, she has looked for the reasons of such a failure. The examination has involved the aims, motives, opposite opinions for the Laws, new arrangements went through and the authority distribution defined by them. The last and current Law on Reconstruction numbered 3194 has been discussed in more detail with its positive and negative sides and reflections on the cities' physical and social situation. After all, some proposals about the legal arrangements have been offered.

İmar düzenlemeleri, imar yasaları adı verilen yasalar çerçevesinde hazırlanır ve uygulanır. Ancak, bu konuda sürekli yeni yasalar çıkarılmakta, yasa değişiklikleri, ek yasalar, yönetmelikler ve sayısız genelgeler ile büyük ,bir hukuk karmaşası yaratılmaktadır. Bu yazıda; Cumhuriyetin ilanından itibaren imar yasalarının gelişimi ele alınmıştır. Her yeni yasanın amacı; gerekçesi, karşıt görüşler,,yeni düzenlemeler ve yetki dağılımına değinilmiş; yasaların başarısızlık nedenleri tartışılmıştır. Yürürlükteki 3194 sayılı îmar Yasası da aynı şekilde irdelenmiş; Yasa olumlu, olumsuz yönleri ve kentlerdeki yansımalarına göre değerlendirilmiştir. Çalışmada imar yasaları konusundaki sorunlar saptanmış ve yasal düzenlemelere ilişkin öneriler geliştirilmiştir.
