Avrupa'da ve Ülkemizde Yerel Yönetimlerin Denetimi ve Etkinliği

Abstract

The activities of local governments are subject to continuous controls. The objective of this article is to examine supervision and audit of the activities of the local authorities in some European countries and Turkey in a comparative manner. Legal supervision is the superintendence of local authority with reference to laws which prevents local authorities from overstepping their competences. Such supervision may be carried out by the central government -i.e. the supervisory body performs administrative supervision and the supervision is carried out by the courts that conduct procedures upon the local authorities. In Turkey, the local government reform and the supervision of local authorities are in the spotlight. It is necessary for Turkey to take advantage of the valuable experiences of all countries where this process started, long time ago -especially the European countries.

Özet

Avrupa'da ve ülkemizde, yerel yönetimlerin çalışmaları üzerinde sürekli ve sonu gelmeyen bir denetim söz konusudur. Denetimin kapsamı, her ülkede birbirinden farklı olmakla birlikte, yerel yönetimlerin üstlendikleri görevlerin artışına paralel olarak genişlemektedir. Bu çalışmanın amacı, Avrupa'nın çeşitli ülkelerinde ve ülkemizde yerel yönetimler (özellikle belediyeler) üzerinde uygulanan denetim usullerinin karşılaştırmalı olarak incelenmesi, etkin bir yerel yönetim denetim sisteminin kurulması arayışları çerçevesinde, ülkemiz açısından benimsenebilecek ve faydalanılacak sonuçlar çıkarılması, son yasal düzenlemelerin ele alınması, etkinliği uzun zamandır tartışılan yerel yönetimlerin denetiminin iyileştirilmesine ilişkin önerilerin getirilmesidir.
