Abstract

Articles 26, 45 and 47/II of CPIL protects consumer in Turkish Private International Law. In consumer contracts choice of law is limited by art. 26 of CPIL to protect consumer, in case the parties have not designated a law, the law of the habitual residence of the consumer shall govern to protect consumer. Another rule which protects consumer in this article is the law of the habitual residence of the consumer shall be applied to the consumer contracts concluded. Pursuant to art. 45 of CPIL according to the preference of the consumer, the Turkish courts in five different places are competent. The competent court is the court of the place where the consumer’s habitual residence is located. Competency of courts specified in art. 45 of CPIL, cannot be removed by the parties’ agreement pursuant to art. 47/II

Özet

MÖHUK 26., 45. ve 47/II. maddeleri Türk milletlerarası özel hukukunda tüketiciyi koruyan düzenlemelerdir. MÖHUK, 26. maddesi ile hukuk seçimini sınırlandırarak tüketiciyi korumuş, tarafların hukuk seçimi yapmamış olması hâlinde ise bu korumayı, tüketicinin mutad meskeni hukukunu uygulayarak sağlamıştır. Tüketiciyi koruyan bu maddede yer alan bir diğer düzenleme ise tüketici sözleşmelerinin şekline, tüketicinin mutad meskeni hukukunun uygulanmasıdır. MÖHUK m. 45 uyarınca tüketicinin seçimine göre, beş ayrı yerdeki Türk mahkemesi yetkili kabul edilmiştir. Tüketiciye karşı açılacak davalarda yetkili mahkeme ise tüketicinin Türkiye'deki mutad meskeni mahkemesidir. MÖHUK m. 45'de belirlenen mahkemelerin yetkisi tarafların anlaş- masıyla (yetki anlaşması) m. 47'ye göre bertaraf edilemeyecektir.
