Abstract

The subject of this paper is the adjustment problem in the foreign currency indexed credits and the view of Turkish Court of Appeals on this matter. Consumers who get foreign currency indexed credit could fall into financial difficulty because of an economic crisis which causes an extreme appreciation of foreign currency. Under these circumstances, consumers could demand the adjustment of the credit agreement from the courts. Courts can adjust the credit agreement in the existence of adjustment provisions. In this paper, adjustment provisions are examined both in general and also specifically with regards to the concept of foreign currency indexed credit. In this respect, opinions in doctrine and practices of Turkish Court of Appeals are examined.
