Abstract
General terms and conditions are used in contracts from many different areas such as banking, insurance, lodging/travel, transportation and employment. Despite having a common use in daily life, there had been no regulations in the Code of Obligations on this topic until statute 6098 was introduced. Prior to that date, even though statute 4077 of Consumer Protection Law provided detailed regulations pertinent to the subject matter, they were restricted only on consumer contracts. Statute 6098 of Turkish Code of Obligations includes regulations on general terms and conditions in an attempt to fix this inadequacy. In this paper, we examine these regulations in detail within the context of its doctrine and provide our views on the areas of application of the laws related to general terms and conditions.

Genel işlem koşulları, günümüzde bankacılık, sigortacılık, seyahat, taşıma ve iş hukuku gibi birçok alanda kullanılan sözleşmelerde yer almaktadır. Günlük hayatımızda bu kadar çok kullanılmasına rağmen, 6098 sayılı Kanunu’na kadar Borçlar Kanunumuzda bu konuya ilişkin hiçbir düzenleme yoktu. Bu dönemde 4077 sayılı Tüketicinin Korunması Hakkında Kanun’da bu konuya ilişkin ayrıntılı düzenlemeler yer alsa da bu maddeler sadece tüketici sözleşmeleri için getirilmişti. 6098 sayılı Türk Borçlar Kanunu bu eksikliği gidermeye çalışarak genel işlem koşullarına ilişkin düzenlemelere yer vermiştir. Çalışmamızda bu düzenlemeler öğretinin görüşleriyle birlikte detaylı bir şekilde incelenecek ve hukukumuzda genel işlem koşullarını içeren düzenlemelerin uygulama alanına ilişkin görüşlerimize yer verilecektir.
