THE ILLEGALITY OF SCIENTIFIC DRUG TREATMENT EXPERIMENTS ON HUMAN

Abstract

It is possible to examine drug experiments under two headings, as therapeutic trials and scientific trials. Our study aims to examine the scientific experimentation of drugs and the people who will be the subject of these studies to find out the illegality of the payment of wages. In practice, the opening of centers where wage-salariency tests should be made clearly and the announcement of these centers through the media channel made it necessary to carry out such a study. After briefly mentioning the scientific trial drug trials, the practical legal arrangements will be examined, and the practical problems related to the non-compliance of the scientific tests with fees will be discussed.

İlaç denemelerini, tedavi amaçlı denemeler ve bilimsel amaçlı denemeler olarak iki başlık altında incelemek mümkündür. Çalışmamız bilimsel amaçlı ilaç denemelerini ve bu çalışmalarda denek olacak kimselere ücret ödenmesinin hukuka aykırılığını incelemeye yöneliktir. Uygulamada ücret karşılığı denemelerin açıkça yapılacağı merkezlerin açılması ve bunun medya kanalıyla duyurulması böyle bir çalışmanın yapılmasını zorunlu hale getirmiştir. Çalışmada öncelikle bilimsel amaçlı ilaç denemelerinden kısaca bahsedildikten sonra, ücrete ilişkin hukuki düzenlemeler incelenecek ve ücret karşılığı bilimsel denemelerin hukuka aykırılığına ilişkin uygulamadaki sorunlar ele alınacaktır.
