6102 SAYILI TÜRK TİCARET KANUNU’NA VE TİCARET SİCİL YÖNETMELİĞİ’NE GÖRE TİCARET SİCİLİ

Abstract

In the Turkish Commercial Code Numbered 6102 articles of 26-40’th, Commercial Register as a matter of concept was regulated. This matter was regulated as not precisely under the provisions of the Trade Registry Regulation too,. In our study, there wil be focused on the organization of trade registry and the concept of the trade register in the context of the aforementioned legislation. Then, respectively will be discussed and researched on these concepts: 1. Commercial register of the properties, 2. The process of the registration, 3. The functions of the trade register. The concept of liability from the actions which is about the trade register will also be addressed in our article. While these studies are conducted, the Supreme Court’s decisions and doctrines about trade registry will also be examined and discussed. And also our thoughts on trade registry will be declared

Özet

Ticaret sicili, 6102 sayılı Türk Ticaret Kanunu'nun 26-40'ıncı maddelerinde hüküm altına alınmıştır. Ayrıca ikincil mevzuat olarak Ticaret Sicil Yönetmeliği de ayrıntılı hükümler içermektedir. Çalışmamızda, anılan mevzuat hükümleri çerçevesinde ticaret sicili kavramı anlatılacaktır. Ayrıca ticaret sicili teşkilatı üzerinde de durulacaktır. Daha sonra sırasıyla; ticaret sicilinin özellikleri, tescil için gereken işlemler ve ticaret sicilinin fonksiyonları ele alı- nacaktır. Ticaret sicilinden doğan sorumluluk kavramı da çalışma konumuzu teşkil edecektir. Doktrin ve Yargıtay kararları ışığında ticaret sicilinin hangi kapsamda ele alındığı da incelenecektir.
