Restriction of the Freedom of Expression in the Judgments of the European Court of Human Rights

Abstract
Freedom of expression is one of the most important elements of a democratic society and enshrined in Article 10 of the European Convention on Human Rights. Article 10 § 2 of the Convention sets forth the cases and conditions in which the freedom of expression may be restricted. As in some of the other fundamental rights and freedoms, freedom of expression is not an absolute freedom, and in certain cases the Contracting States may interfere. There areas of interference shall be determined in line with the principle of numerus clausus. Within the scope of Article 10 § 1 of the Convention, the issue whether there has been interference with the freedom of expression shall be examined on the such basis’ as “whether the interference is prescribed by law”, “whether the interference pursues a legitimate aim” and “whether the interference is necessary in a democratic society”
Özet
İfade özgürlüğü, demokratik toplumun en önemli unsurlarından biridir ve Avrupa İnsan Hakları Sözleşmesi’nin 10. maddesinde düzenlemiştir. Sözleşme’nin 10/2. maddesinde ise ifade özgürlüğünün hangi durumlarda ve hangi şartların gerçekleşmesi halinde sınırlandırılabileceği düzenlemiştir. Diğer bazı temel hak ve özgürlüklerde olduğu gibi, ifade özgürlüğü de mutlak bir özgürlük olmayıp, belirli durumlarda Sözleşmeci Devletler tarafından müdahale edilebilecektir. Müdahale alanları sınırlı sayı prensibine göre sayılmıştır. Sözleşme’nin 10. maddenin ilk fıkrası çerçevesinde ifade özgürlüğüne bir müdahale olup olmadığı; gerçekleştirilen müdahalenin “yasayla öngörülmüş olup olmadığı”, “müdahalenin meşru amaçlara dayanıp dayanmadığı” ve “müdahalenin demokratik bir toplumda gerekli olup olmadığı” temelinde incelemektedir
