Abstract

A person’s finding out her genetic paternity is accepted as a fundamental right recognized by national and international courts. There are many cases in the German and Swiss judiciary where only the origin is identified, independent from the request for the establishment or abolition of the legal paternity. It is accepted the fact that such a case is also possible in Turkish law by doctrine. However, violations of many fundamental rights such as body integrity, protection of private life and family life may come to a question due to a request for the detection of genetic paternity with the biological father of a person. Within our study, the request for the detection of genetic paternity in the light of the decisions given by the Constitutional Court of the Republic of Turkey and The Federal Constitutional Court German and Federal Supreme Court of Switzerland; also the relationship between the request and fundamental rights are investigated

Özet

Kişinin gerçek soybağını öğrenmesi, gerek ulusal gerekse yabancı yargı kararlarında temel hak olarak kabul edilmektedir. Alman ve İsviçre yargısında soybağının kurulması ya da kaldırılması talebinden bağımsız olarak sadece kökenin tespit edilmesine yönelik birçok dava ile karşılaşılmaktadır. Böyle bir davanın Türk hukuku açısından da mümkün olduğu öğretide kabul edilmektedir. Ancak kişinin biyolojik babasının kim olduğunun tespitine yönelik bir talep karşısında, vücut bütünlüğünün, özel hayatın ve aile hayatının korunması gibi birçok temel hakkın ihlali gündeme gelebilecektir. Çalışmamızda Türk ve Alman Anayasa Mahkemelerinin ve verdiği kararlar doğrultusunda kökenin tespiti talebi ve bu talebin diğer temel haklarla ilişkisi incelenmiştir
