THOUGHTS ON THE JURISDICTION OF THE TURKISH FOOTBALL FEDERATION DISPUTE RESOLUTION BOARD

TÜRKİYE FUTBOL FEDERASYONU UYUŞMAZLIK ÇÖZÜM KURULUNUN YARGI YETKİSİ ÜZERİNE DÜŞÜNCELER

Abstract

It is prescribed that resolution of some disputes including the disputes arising from football contracts with the order of the Dispute Resolution Board and Turkish Football Federation Statute, Turkish Football Federation Dispute Resolution Board is competent and civil courts do not have jurisdiction. Due to these regulations, resort to Turkish Football Federation Dispute Resolution Board arbitral committee is made compulsory for the parties when a dispute arises. It should be interpreted whether this compulsion is a compulsory arbitration or for forcing parties to make an arbitration agreement. Can the right to be tried before an independent and impartial tribunal established by law, which is an element of the right to fair trial be taken away from the parties with the Statute and orders? In our study the answers of these questions are tried to be given.

Talimatı ile futbolla ilgili sözleşmeden doğan uyuşmazlıklarda dâhil olmak üzere, bazı uyuşmazlıkları çözmek için Türkiye Futbol Federasyonu Uyuşmazlık Çözüm Kurulu'nun görevli olduğu ve adli yargıya gidilemeyeceği öngörülmektedir. Bu düzenlemeler nedeniyle tarafların uyuşmazlık çıkması halinde Türkiye Futbol Federasyonu Uyuşmazlık Çözüm Kurulu hakem heyetine başvurmaları zorunlu hale getirilmiştir. Bu zorunluluğun, mecburi tahkim mi yoksa tarafları tahkim sözleşmesi yapmaya zorlama mı olduğunun yorumlanması gerekir. Statü ve talimatlarla tarafların, adil yargılanma hakkının unsurlarından olan bağımsız, tarafsız ve kanunla kurulmuş bir mahkeme önünde yargılanma hakları ellerinde alınabilir mi? Çalışmamızda bu soruların cevabı verilmeye çalışılmaktadır.
